At the point of payment, you are transferred to a secure page on the website PayPal or if paying by credit/debit card payment is taken via Stripe payment gateway. No payment details are kept on our website or servers. All payment data is fully secure and safe and processed through stripe who is fully PCI compliant.

When you contact us, whether by telephone, through our website or by e-mail, we collect the data you have given to us in order to reply with the information you need.

2.1 Data you provide.

When you sign up for a Desk Yogi account, we ask you for personal information (such as your name, e-mail address and an account password and may require your date of birth, gender, mailing and billing address, and zip code). At the time you register as a member or during your free trial period, we also request credit card or other payment account information which we maintain in encrypted form on secure servers. We may combine the information you submit under your account with information from other Desk Yogi services or third parties in order to provide you with a better experience and to improve the quality of our services.

We make your profile available to other users according to the privacy settings you set for yourself as part of your profile. This may include activity and progress on the site, such as completion of challenges, ranking on leaderboards, and achievements, as well as the ability to send and receive messages from others.  Your user name will be identified to us and to any recipient of messages you send through the Service.

We also use your name, e-mail address and other information on our system to notify you of new product releases, service notifications, events, and to solicit your feedback and input. We may also use your information, or a portion thereof, to send you marketing materials and/or Desk Yogi newsletters or other information Desk Yogi thinks you may need, unless you notify Desk Yogi that you do not wish to receive such materials. Account Data In order to access Desk Yogi content, you need to create a user account. When you create or update your account, we collect and store the data you provide, like your name, email address, password, and assign you a unique identifying number (“Account Data”).
Profile Data You can also choose to provide profile information like a photo. Your Profile Data will be publicly viewable by other members.
Shared Content Parts of the Services let you interact with other users or share content publicly, including by posting comments or liking a course page, asking or answering questions, sending messages to group members, or sharing on third party services. Such shared content may be publicly viewable by others depending on where it is posted.
Video Views Data When you watch videos in our site, we collect certain data including which videos and series you’ve started and completed, in order to show your achievements in your personal statistics dashboard and your Group Leaderboard if you are a member of a Group.
Payment Data If you make purchases, we collect certain data about your purchase (such as your name and zip code) as necessary to process your order. You must provide certain payment and billing data directly to our payment processing partners, including your name, credit card information, billing address, and zip code. For security, Desk Yogi LLC does not collect or store sensitive cardholder data, such as full credit card numbers or card authentication data.
Data About Your Accounts on Other Services We may obtain certain information through your social media or other online accounts if they are connected to your Desk Yogi account. If you login to Desk Yogi via Facebook, Google, LinkedIn, Single Sign On or another third-party platform or service, we ask for your permission to access certain information about that other account. For example, depending on the platform or service we may collect your name, profile picture, account ID number, login email address, work location.

Those platforms and services make information available to us through their APIs. The information we receive depends on what information you (via your privacy settings) or the platform or service decide to give us.

Sweepstakes, Promotions, and Surveys We may invite you to complete a survey or participate in a promotion (like a contest, sweepstakes, or challenge), either through the Services or a third-party platform. Desk Yogi may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our Website.

Other websites.

This Policy applies to websites and services that are owned and operated by Desk Yogi. We do not exercise control over the websites displayed as search results or links from within our various services. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you.

Subject to Desk Yogi’s adherence with the privacy settings you select within the Desk Yogi Platform, you hereby grant to Desk Yogi a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license, with the right to sublicense, to reproduce, distribute, transmit, publicly perform, publicly display, digitally perform, modify, create derivative works of, and otherwise use and commercially exploit any text, photographs or other data and information you submit to Desk Yogi (collectively, “User Generated Content”) in any media now existing or hereafter developed, including without limitation on websites, in audio format, and in any print media format. “User Generated Content” includes but is not limited to content posted on message board posts, blogs, journals, and user comments. Subject to Desk Yogi’s adherence to the privacy settings you select within your Desk Yogi Account Settings, you hereby waive any rights of publicity and privacy with respect to the User Generated Content and any other legal or moral rights that might preclude Desk Yogi’s use of the User Generated Content or require your permission for Desk Yogi to use the User Generated Content. You agree not to assert any claim, whether based on tort, contract, or other legal theory, against Desk Yogi or its sublicensees relating to Desk Yogi’s or its sublicensees’ use of the User Generated Content in accordance with your privacy settings, and you hereby release Desk Yogi and its sublicensees from any such claims. You represent that your User Generated Content: (1) will not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights; (2) will not violate any law, statute, ordinance or regulation; (3) will not be obscene or contain pornography; (4) will not contain any viruses, worms, time bombs or other computer programming code that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (5) will not violate any third party’s rights of publicity or privacy; and (6) will not be defamatory, unlawfully threatening or harassing, harmful to minors in any way, or otherwise offensive or inappropriate.   1. What Does Desk Yogi Do With The Collected Information?

Personal information.

Desk Yogi processes personal information on its servers in the United States of America and in other countries. In some cases, we process personal information on a server outside your own country. We provide personal and non-personal information to our subsidiaries, affiliated companies or other trusted third parties or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such personal information based on our instructions and in compliance with the appropriate confidentiality and security measures.

We may also disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on Desk Yogi or its parent company, subsidiaries, or affiliates, (2) protect and defend the rights or property of Desk Yogi or the users of the Website, or (3) act under exigent circumstances to protect the safety of the public or users of the Website.

We use appropriate security based on the type and sensitivity of data being stored. As with any internet-enabled system, there is always a risk of unauthorized access, so it’s important to protect your password and to contact us if you suspect any unauthorized access to your account.

Desk Yogi takes appropriate security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal data that we collect and store. These measures vary based on the type and sensitivity of the data. Unfortunately, however, no system can be 100% secured, so we cannot guarantee that communications between you and Desk Yogi, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Maintenance of personal information.

You can access your information contained in Desk Yogi’s database by contacting us. If you believe any of your information is incorrect or needs updating, contact us at support@desk-yogi.com

. Desk Yogi will use reasonable efforts to correct your information and our records upon verification of the requested change. If you no longer wish to receive email notifications from Desk Yogi, please let us know by contacting us In the text of your email, specify which notifications you no longer wish to receive and provide your exact name, email address and/or address so that we can do our best to ensure that you stop receiving the notifications that you no longer wish to receive. After such a request is received, Desk Yogi will use reasonable efforts to refrain from including you when sending such notifications to Desk Yogi’s visitors/users/customers.

We do not currently maintain any procedures for you to review the information that we collect about you.

Retention of personal information.

When you close or de-activate your account or if your account is otherwise terminated, we have the right, but not the obligation, to store your personal information, settings, saved and completed classes, and teachers you have followed.

Information Security. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to Desk Yogi employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

However, please note that no data transmission over the Internet can be guaranteed to be 100% secure, so while Desk Yogi strives to protect your information, Desk Yogi cannot ensure or warrant the security of any information that you voluntarily give to Desk Yogi.

Accessing and updating personal information.

When you use the Service, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

We recognize the privacy interests of children and encourage parents and guardians to take an active role in their children’s online activities and interests. Children under 13 (or under 16 in the European Economic Area) should not use the Services. If we learn that we’ve collected personal data from a child under those ages, we will take reasonable steps to delete it.

10.1 Users in California

If you live in California, you have certain rights to request information. Users outside of the United States should note that we transfer data to the US and other areas outside of the European Economic Area.

If you are a California resident, you have the right to request certain details about what personal information we share with third parties for those third parties’ direct marketing purposes. To submit your request, send an email to info@desk-yogi.com and include your mailing address, state of residence, and email address.

Since the internet industry is still working on Do Not Track standards, solutions, and implementations, we do not currently recognize or respond to browser-initiated Do Not Track signals.

10.2 Users Outside of the U.S.

Desk Yogi LLC is headquartered in California, and in order to provide the Services to you we must transfer your data to the United States and process it there. By visiting or using our Services, you consent to storage of your data on servers located in the United States. If you are using the Services from outside the United States, you consent to the transfer, storage, and processing of your data in and to the United States or other countries. Specifically, personal data collected in Switzerland and the European Economic Area (“EEA”) is transferred and stored outside those areas.

That data is also processed outside of Switzerland and the EEA by our staff, our service providers, including to process transactions, facilitate payments, and provide support services as described above. We have entered into data processing agreements with our service providers that restrict and regulate their processing of your data on our behalf. By submitting your data or using our Services, you consent to this transfer, storage, and processing by Desk Yogi and its processors.

Third party links, co-brand relationships and public forums.

In an attempt to provide increased value to our visitors, Desk Yogi may choose various third party websites to link to, link from, and frame within, the Website. Desk Yogi also may participate in co-branding and other relationships to offer e-commerce and other services and features to its users. However, even if the third party is affiliated with Desk Yogi, we have no control over these linked sites, each of who have separate privacy and data collection practices independent of Desk Yogi. We also may make community features available to you on the website, such as challenges and leaderboards, sharing of content and achievements, chat rooms, forums and message boards. Please remember that we cannot control the information that is shared by members and that anything you voluntarily provide in any public area of the Internet will be publicly available to other visitors on that web site and potentially to other third parties. Thus, please note that you should always exercise caution when deciding to publicly disclose any of your personal information in these and similar areas.

Desk Yogi regularly reviews its compliance with this Policy. Please feel free to direct any questions or concerns regarding this Policy or Desk Yogi’s treatment of personal information by contacting us at support@desk-yogi.com When we receive formal written complaints at this address, it is Desk Yogi’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Desk Yogi and an individual.
